The boundary between technical accuracy and legal assessment
The scope of technical expertise, the language of findings and the expert's responsibility to the decision-maker.
The reliability of a digital forensic examination does not depend solely on the tool used or the record discovered. How the data was acquired, how its integrity was preserved, whether the analysis can be reproduced and how the limits of the finding are expressed are equally important.
A technical expert verifies records, separates data layers, measures relationships and considers alternative explanations. A technical finding alone, however, may not establish a person's intent, legal responsibility or actual control of an address.
In blockchain examinations, for example, the occurrence of a transfer may be technically verified. Address ownership, transaction intent and the legal relationship between parties require different layers of evidence.
The expert's role is not to create an appearance of certainty, but to explain clearly what the available data does and does not verify. This boundary does not weaken a report; it strengthens its scientific and legal reliability.
